Terms and Conditions

The Treating physician or provider will reach his or her conclusions regarding a medical diagnosis based solely on the information provided by the patient (describes a user of the mySkinDoc service)

Patients must understand and agree that:

  1. Online consult is solely based on the information provided by me and, in the absence of a physical evaluation, the provider / treating physician may not be aware of certain facts that may limit or affect his or her assessment or diagnosis of my condition and recommended treatment.
  2. Online consultation is very different from a regular face-to-face examination and that the Treating physician / Provider providing the consult is limited by the written information and imaging provided by me. Accordingly, the diagnosis I will receive is limited and provisional.
  3. An online consult is not intended to replace a full medical face-to-face evaluation by a physician.
  4. The Treating physician / provider is only rendering an online consult and does not assume any responsibility for my continued medical care or treatment.
  5. My medical information will be handled with strict confidentiality, privacy and security; however, I understand there are risks associated with any electronic transfer process from one location to another.
  6. I have read the Privacy Policy located on the website footer.

Patients solely assume the risk of the limitations set forth herein, and further understand that no warranty or guarantee has been made to me concerning any particular result related to my condition or diagnosis.

This User and Software License Agreement ("USLA") is a legal agreement between you and MK Aesthetics Ltd t/a mySkinDoc, Registered office Kemp House, 152-160 City Road, London, EC1V 2NX. This USLA applies to the use of the mySkinDoc service (the "Service") and the software originating from mySkinDoc (the "Software").

By using all or any portion of the Software originating from mySkinDoc, you accept all the terms and conditions of this USLA. To utilise the Software or to send content via the mySkinDoc webapp through the www.myskindoc.co.uk (the "Website"), is considered use of the Service and the Software as applicable. By using the Service you agree to MK Aesthetics ltd t/a mySkinDoc handling your submission, information and image, to respond to your query.

If you do not agree to the terms of this USLA, you are not entitled to use the Software or Service.

ABOUT THE SERVICE

The Service that mySkinDoc provides does not in any way replace a traditional face-to-face examination by a dermatologist.

mySkinDoc is an online consultation tool whereby patients provide information of their clinical details filled in via a Web App and can upload pictures of their skin condition to our secure server. The information will then be viewed by a clinician who specialises in dermatology. The clinician will then provide their opinion of the likely diagnosis and a suitable management plan via email in the form of a PDF.

COSTS

The cost of the Service is the price announced on the Website or through the Software at the time of your use of the Service. mySkinDoc reserves the right to change the price without notice. It is therefore important to check the price before use of the Service.

If any erroneous transactions are made, a case-by-case inquiry will be made and if the payment is shown to be erroneous, a refund will be made in an appropriate manner.

PAYMENT

mySkinDoc aims to deliver a reply to your consultation within 2 working days.

Payment will be made during completion of the online form securely via Stripe. An email receipt will be sent to you after payment has been taken.

COPYRIGHT

All copyright and other intellectual, industrial and/or proprietary rights to the Software, and all content provided through the Service, are owned by MK Aesthetics Ltd t/a mySkinDoc. mySkinDoc permits you to use the Software only in accordance with the terms of this USLA. All rights not specifically granted in this USLA are reserved by MK Aesthetics Ltd t/a mySkinDoc. You grant MK Aesthetics Ltd t/a mySkinDoc a non-exclusive license to use the image(s) provided by you in the use of the Service for all commercial and scientific uses.

OTHER RESTRICTIONS

Renting, lending, public presentation, performance or broadcasting or any other kind of distribution of the Software is prohibited. Other than as permitted by applicable legislation, you will not, and you will not allow any person to, modify the Software or any part thereof, to analyze it by means of reverse engineering, to decompile or disassemble the Software or to make products derived from it.

CONFIDENTIALITY OF INFORMATION RECEIVED BY IDOC24

All information received from you and the corresponding answers are kept on a secure HIPAA compliant and GDPR AWS server. Your details and details of consultation are only accessed by administrators working in the best interest of the patient or by the clinicians performing the assessment. You should keep your case number in a secure place and not share it with others. If you do choose to contact mySkinDoc for any reason such as but not limited to providing feedback, requesting a refund, reporting a bug, we encourage you to provide your case ID in order for us to track your details.

LIMITATION OF LIABILITY

Skin diseases can be difficult to diagnose and treat. The Service that mySkinDoc provides does not replace a traditional face-to-face examination by a dermatologist.

Neither mySkinDoc, including all employees or affiliated individuals such as partners or contractors cooperating with mySkinDoc, nor any clinician working for mySkinDoc under contract or other agreement, are in any way responsible for any direct or indirect loss or damages in connection with the advice given. This includes any consequences following any decision that you make on the basis of the advice obtained through the Service.

mySkinDoc shall bear no liability for errors in the Service unless as required by law. This includes all direct or indirect liability for typographic errors, errors in information, errors in the specification, errors in pictures and illustrations, delivery delays, Service downtime, loss of case data.

AMENDMENTS TO THE OFFERED SERVICE

mySkinDoc reserves the right to amend any information, including but not limited to prices, specifications and product offerings without prior notice. Current information is found on the Website and through the Software.

FORCE MAJEURE

If and to the extent that mySkinDoc performance in fulfilling the obligations pursuant to this USLA is, hindered or delayed due to circumstances beyond the reasonable control of mySkinDoc, such as, lightning, labour disputes, fire, acts of war, requisition, seizure, currency restriction, riots and civil disorders, shortage of means of transportation, shortage of goods, amendments to regulations issued by governmental authorities, intervention of authorities (each, a "Force Majeure Event"), then mySkinDoc shall be excused from any performance or liability of those obligations affected by the Force Majeure Event for as long as such Force Majeure Event continues. If mySkinDoc performance is prevented, hindered or delayed by a Force Majeure Event mySkinDoc shall immediately notify you of the occurrence of the Force Majeure Event via the Website. MySkinDoc shall, however, always mitigate the effects of the Force Majeure Events.

TERMINATION

Without prejudice to any other rights, mySkinDoc may immediately terminate this USLA if you fail to comply with any of its terms and conditions. Termination will result in an indefinite ban from the Service without the possibility of compensation for your costs spent. The provisions of this USLA, which by their nature are intended to survive termination, will remain in effect after termination of this USLA.

ENTIRE AGREEMENT

This USLA (including any addendum or amendment to it which may be supplied with the Software) is the entire agreement between you and mySkinDoc relating to the Software and it supersede all prior or contemporaneous oral or written communications, proposals and representations with respect to the Software or any other subject matter covered by this USLA. If any provision of this USLA is held to be void, invalid, unenforceable or illegal, the other provisions shall continue in full force and effect.
